Terms of service
Last updated 5 October 2026
These terms govern your use of Haba Social. Please read them before you create an account, because by creating one you agree to be bound by them.
1. Who you are contracting with
Haba Social is operated by HABA GROUP LIMITED, a company registered in England and Wales with company number 16671643, whose registered office is at 86-90 Paul Street, London, England, EC2A 4NE. In these terms, "Haba", "we", "us", and "our" mean HABA GROUP LIMITED, and "you" means the person or business using the service.
These terms, together with our privacy policy and cookie policy, form the whole agreement between us. They take effect when you create an account or start using the service, whichever is first.
2. Definitions
- Organisation — the workspace that holds your plan, your team, and your billing.
- Brand — a client or project inside an organisation, with its own channels, calendar, media, and reports.
- Channel — a social media account you connect to a brand so that Haba can publish to it and read its metrics.
- Content — posts, captions, comments, images, videos, documents, credentials, and anything else you or your team put into the service.
3. Your account
You must be at least 18 and, if you are signing up for a business, authorised to bind that business. Give us accurate details and keep them current. You are responsible for everything that happens under your account, including what the people you invite do, so keep passwords secure and tell us promptly at [email protected] if you think an account has been compromised.
4. Trial, plans, and billing
- New organisations get a 7-day free trial with no card required. If you do not choose a plan by the end of it, the account moves to a read-only state: you can still reach and export your data, but publishing and scheduling stop.
- Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. Prices are shown exclusive of VAT or other applicable taxes unless stated otherwise.
- Extra-post packs are one-off purchases. Unused extras expire when your included allowance resets on the 1st of the month and do not roll over.
- Additional brands, seats, and add-ons such as white-label are charged at the rates shown on our pricing page at the time you add them.
- If a payment fails we may retry it and will tell you. If it stays unpaid we may move the organisation to a read-only state or suspend it.
- We can change prices, and will give you at least 30 days’ notice by email before a change affects your next renewal. If you do not accept it, cancel before that renewal.
- You can cancel at any time from billing settings. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then.
5. Refunds
Refunds are awarded at our discretion, on a case-by-case basis. We will look at any request fairly and on its own facts, but as a rule we do not refund a billing period once the subscription has been used during it. Using the service includes publishing or scheduling posts, connecting channels, generating reports, or otherwise making material use of the plan.
Cancelling part-way through a billing period does not generate a pro-rata refund for the remaining days, and extra-post packs and other one-off purchases are non-refundable once used. Request a refund by emailing [email protected] from the address on the account.
Nothing here removes your statutory rights. If you are a consumer rather than a business, your legal rights under UK consumer law, including any right to cancel a distance contract, continue to apply in full.
6. Fair use
Plan limits are set for normal professional use. Fair use means using the service the way it is meant to be used, and not in a way that degrades it for everyone else or shifts our costs onto other customers. In particular:
- Publishing and API volume. Do not generate post, request, or automation volume that is materially beyond what your plan contemplates, and do not drive the service through scripts or integrations that place a disproportionate load on it or on the platforms we publish to.
- Storage. The storage included with your plan is for social media assets tied to your brands. It is not general-purpose file storage, backup, archiving, or a place to host media you serve elsewhere.
- AI credits. AI assistance is for drafting and refining your own content. Do not consume credits through bulk, automated, or resold generation, or use them to run a separate service on top of ours.
- Seats and access. Each seat is for one named person. Do not share logins, pool a seat across several people, or resell, sublicense, or provide access to the platform to third parties, except as the white-label terms of the Agency plan allow.
If usage goes beyond fair use, we will normally contact you first and try to find a sensible answer. Where that does not resolve it, or where the usage is causing immediate harm to the service, we may throttle the activity, require an upgrade to a plan that fits, charge for the excess, or suspend the affected functionality. We will act proportionately and will tell you what we have done and why.
7. Acceptable use
You agree not to use Haba Social to:
- send spam, or publish deceptive, misleading, or artificially amplified content;
- post content that is unlawful, defamatory, obscene, harassing, hateful, or that infringes anyone’s intellectual property or privacy;
- breach the terms, policies, or rate limits of any social platform you connect;
- publish to accounts you are not authorised to manage;
- probe, scan, or interfere with the service or its infrastructure, or try to gain access to data that is not yours;
- reverse engineer, decompile, or copy the service, or use it to build a competing product; or
- upload malware or anything else designed to cause harm.
8. Connected platforms
Haba publishes through the APIs of third-party social platforms, in part via our publishing partner Post for Me. Those platforms are outside our control. They can change, restrict, or withdraw their APIs, reject or delay a post, or suspend an account, and you remain subject to their own terms for each account you connect. We will make reasonable efforts to publish what you schedule, but we cannot guarantee that any particular post will be delivered, delivered on time, or remain available, and we are not liable for a platform's own acts or omissions.
9. Your content
You keep all ownership of your content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, adapt for formatting, transmit, and publish it, solely to the extent needed to operate the service and to carry out your instructions. That licence ends when the content is deleted, except for copies retained in backups for the period described in our privacy policy.
You confirm that you have the rights and permissions needed for the content you upload and the accounts you connect, including from clients, employers, and anyone appearing in your media.
10. Our intellectual property and your feedback
The service, including its software, design, branding, and documentation, belongs to us and our licensors. Your plan gives you a limited, non-transferable, revocable right to use it for the duration of your subscription, and nothing more. If you send us ideas or suggestions, we may use them freely and without obligation to you.
11. Availability and support
We aim to keep Haba Social available at all times, but we do not promise uninterrupted service. We may need to carry out maintenance, and will try to schedule planned work outside busy periods and to give notice where we can. Support is provided by email at [email protected], with priority handling on the Agency plan. We do not offer a contractual service level unless we have agreed one with you in writing.
12. Suspension and termination
You may close your account at any time. We may suspend or terminate your access if you breach these terms, if your payment remains unpaid, if your use creates a legal or security risk, or if we are required to by law. Where it is reasonable to do so, we will warn you first and give you a chance to put things right.
After termination you will normally have 30 days to export your content before it is deleted. We may keep records we are legally required to keep. Fees already paid are handled under section 5.
We may also discontinue the service as a whole. If we do, we will give you reasonable notice and refund any prepaid fees covering the period after it stops.
13. Disclaimers
Beyond what these terms expressly say, and to the fullest extent the law allows, the service is provided as is and we exclude all implied warranties. We do not warrant that the service will be error-free, that metrics retrieved from social platforms will be complete or accurate, or that AI-generated suggestions will be suitable. You are responsible for reviewing content before it is published.
14. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, we are not liable for loss of profit, revenue, business, goodwill, anticipated savings, or data, or for indirect or consequential loss, however it arises. Our total liability to you in connection with the service, in contract, tort including negligence, or otherwise, is limited to the total fees you paid us in the 12 months before the event giving rise to the claim, or £100 if you have paid us nothing.
15. Indemnity
If you are using the service for business purposes, you will indemnify us against claims, losses, and reasonable costs arising from your content, from your use of the service in breach of these terms, or from your lack of authority over an account you connected.
16. Changes to these terms
We may update these terms as the product and the law develop. The date at the top shows the current version. For material changes we will give at least 30 days' notice by email or in the app, and continuing to use the service after a change takes effect means you accept it.
17. General
You may not transfer your rights under these terms without our consent; we may transfer ours as part of a reorganisation or sale of the business. If any provision is found unenforceable, the rest stays in force. A delay in enforcing a right is not a waiver of it. Nobody other than you and us has any right to enforce these terms.
18. Governing law
These terms and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
